The following terms and conditions of sale (the "Terms of Sale") will apply to all purchases made through the website bbarriqule.com (the "Website"). The terms "the User" and "Your" refer to you, the user of the Website and purchaser of the goods.

This PART A provides important information regarding the Website and the goods offered for sale through the site.

  • We strive to ensure that all information provided on the Website, including descriptions of our goods and the prices listed, is accurate and correct at all times. However, errors may still occur. We will attempt to correct any errors in the information on the Website as soon as reasonably possible, and if we believe that such errors may have affected the user's order, we will make every reasonable effort to communicate this to them through the contact information provided in their account or during the order process.
  • Buying products online represents a shopping experience different from purchasing in a store. In particular, the user should know that:
  1. The colors of the item(s) as shown on the Website depend on numerous factors, including display settings;
  2. The actual sizes and shapes of the item(s) may differ from how they appear on the screen. Please note that all relevant technical information is provided for each item for sale on the Website;
  3. The photos and images on the website are for illustrative purposes only. For an accurate description of each item and the details of what is included with it, please refer to the corresponding written description.
  4. All goods are subject to availability and we may not be able to fulfill the order placed. We reserve the right to withdraw any product from sale at any time;
  5. We will do our best to arrange the delivery of the item(s) within a reasonable time frame from the order, in accordance with applicable laws and these Terms of Sale. However, it should be noted that we receive all tracking information from our shipping service provider, and the delivery timing is only estimated. Actual delivery dates may vary. Further delivery details will be available on the tracking website of our shipping service provider. Please refer to PART B below for more information on delivery;
  6. Not all goods and promotions offered on the Website will be available in-store, and vice versa. We reserve the right to adjust prices, items, and special offers at our discretion on this Website, in accordance with all applicable laws and regulations. Such changes will not affect orders already placed, even those made prior to our acceptance.
  7. We will do our best to perform antivirus checks on the website, but we do not guarantee that it is free of viruses or other harmful content for the personal computer, tablet, smartphone, or other device used by the user. For their part, the user must ensure that they have appropriate software and systems installed for antivirus checks and other harmful content on the internet. This does not affect the conditions stated in the Terms and Conditions of Use.

Availability

  • We have the right to modify or discontinue the Website at any time, as well as to suspend the sale of one or all items through it, either temporarily or permanently, with or without notice. We will not be liable to the user for any modification, suspension, or interruption of the availability of the Website.

2. Product Availability: Despite our ongoing efforts to ensure a wide range of products, some items may sell out quickly during Black Friday. In the event that a specific product is out of stock, we cannot guarantee its immediate availability during the Black Friday period.

3. Orders: In the event that a product is not available, the customer will be promptly informed and will have the option to cancel the order, replace it with a similar product, or wait for the product to become available again.

4. Out of Stock Orders: If the purchased item is out of stock, we will arrange to obtain the missing item and deliver the product to you as soon as possible. You will be informed about the expected delivery times for your order.

*During promotional and sale periods, despite the immediate availability of products, there may be delays in processing and shipping orders due to the high volume of requests. We are committed to processing and delivering each order as quickly as possible while maintaining a high standard of quality in our service.

6. Customer Support: Our customer support team is available to answer questions and provide assistance. For any inquiries regarding product availability or to receive support.

Security

  • It is the user's responsibility to ensure at all times the confidentiality of any access data or password and any other type of data related to their account. The user agrees to notify us as soon as possible if they become aware of or reasonably suspect that the security of their account is at risk. We remind the user that, except as provided in the Privacy Policy, at the time of registration on this website, they will be asked to provide complete, up-to-date, and accurate information, as it is expressly prohibited to use names, credentials, or profiles that do not match the user's personal identity.

Part B - purchase of goods

  • This PART B establishes the terms applicable to the purchase of goods from the Website by the user.

Place an order

  • Once the desired items are selected, the user will be asked to register with their personal information by completing a registration form. Registration is not mandatory; however, we strongly recommend it in order to facilitate the purchasing process during future orders on the Website. The user will always have the option to complete their orders as a "guest" without any registration on the Website. The user will also be required to provide their debit or credit card information in order to allow us to receive payment after the order is accepted. The presentation of the item(s) on the Website and the request to provide such data and information does not constitute a contractual obligation for Barriqule to supply the goods until the order has been fully accepted in accordance with the terms that follow, and subject to the application of any binding local law.
  • To verify that the user's data is correct and to manage the payment on our behalf, Barriqule uses an external service provider for payment processing. The user's personal data, including credit card information, will be transferred and held by this external payment processor or by other parties we may use to perform fraud checks. We will not store any credit or debit card data. By placing the order, the user expressly consents to the transfer of their data for this purpose. Such data will be processed in accordance with the terms of the Privacy Policy, subject to any further legal provisions applicable in their country of residence.
  • Qualora dovessimo riscontrare eventuali imprecisioni durante la verifica dei dati o una discrepanza nelle informazioni della carta di credito o di debito, la procedura di acquisto potrebbe essere ritardata, sospesa o interrotta.
  • Dopo aver effettuato un ordine attraverso la sezione dedicata del nostro Sito web, l’utente potrà accedere a una pagina di conferma, che riassume il suo ordine, e riceverà una e-mail di conferma dell’ordine (collettivamente le "Conferme d’Ordine"). L’utente sarà tenuto a ricontrollare attentamente tutti i dati e le informazioni indicati nelle Conferme d’Ordine, verificando che corrispondano alle sue intenzioni.   • Order confirmations contain the details of the items ordered, the total cost of the order, including delivery, and an order number, as well as any other information required by law. Order confirmations represent the user's commitment to purchase the goods and an authorization to charge the corresponding price to the credit or debit card, pending confirmation and acceptance of the order by Barriqule, regarding all or part of the items listed therein.
  • If any applicable local laws in the user's country establish that the presentation of the item(s) on the website constitutes a binding offer, the Order will be considered binding for Barriqule, unless the latter refuses to supply one or more items listed in the Order Confirmations for just cause. In the event of an order refusal, the user will be informed as soon as reasonably possible.

Order Acceptance

  • The acceptance of the order will be communicated to the user through the sending of an email with the confirmation of the contract and the subsequent shipment of the purchased items (the "Shipping Confirmation"). The contract between the user and Barriqule will therefore be considered in effect from the date of the shipping confirmation email and will refer exclusively to the items listed therein.
  • The shipping confirmation will contain information about the purchased goods, a copy of the terms of sale, and information regarding the right of withdrawal, in addition to the purchase receipt. Prices will include VAT and any other applicable taxes for the specific transaction. The receipt will serve as proof of purchase for the items and can be retrieved at any time by sending a written communication to info@barriqule.com. It is strongly recommended to print a copy of the receipt, along with a copy of these terms of sale and the additional policies, and to keep them safe. If the user contacts us regarding the order placed, it may be necessary to refer to these documents.

Payment

  •  The payment will be charged to the user's credit or debit card at the moment they receive the Order Confirmation via email. This email will also include all the information regarding the payment method. We will contact the user in case of issues in collecting the payment through the card details they provided during the ordering process. If the payment fails or is not completed, Barriqule will be exempt from delivering the item(s), without prejudice to any other remedy and right.
  • All prices listed on the Website are inclusive of VAT and other applicable taxes. Notwithstanding any specific terms related to the delivery of items stated in the Shipping Information, we will not charge the user any shipping fees for delivering items to their shipping address. Except as otherwise provided in these Terms of Sale, the price to be paid for the goods is the price indicated in the corresponding Order Confirmations at the time of the order.

Price errors

  • Although we strive to ensure the accuracy of all prices listed on the Website, errors may occur. If, before our acceptance of the order as indicated by the Shipping Confirmation, we detect an error in the price of the ordered goods, we will inform the user as soon as reasonably possible, unless otherwise provided by applicable consumer protection law. The user will then have the option to reconfirm their order at the correct price or to cancel it.
  • If we are unable to contact the user through the contact information provided during the ordering process, we will consider the order canceled and will notify them via email.
  • This does not prejudice any rights and provisions applicable to the user in their capacity as a consumer, in accordance with any applicable consumer protection laws.
  • Final Use Only The goods sold on this website are intended exclusively for the private final use of consumers and are not intended for resale or commercial distribution. The user declares that they are purchasing the products as a consumer. Warranty Information regarding the user's warranty rights for each type of product is provided in our Warranty. These warranties are in addition to and do not limit the legal rights recognized to the user in their capacity as a consumer, as provided by any applicable laws and regulations in their country of residence. Force Majeure Events We will not be responsible for any delay or failure to comply with these Sales Conditions or the supplementary Policies if such delay or failure arises from any unforeseeable, unavoidable event beyond our reasonable control, such as accidents, national legislation, court orders, official sanctions or embargoes, industrial action, fire, flood, adverse weather conditions, natural disasters, or any other natural calamity. Waiver The delay in exercising or the failure to exercise any right or remedy by us under these Sales Conditions will not constitute a waiver of our rights and remedies under these Sales Conditions. Invalidity If one or more provisions set forth in these Sales Conditions or the supplementary Policies are deemed invalid by a competent authority, to the extent possible, the remaining provisions of the Sales Conditions and the supplementary Policies will remain in effect, and the user will always be bound by them. Privacy Personal information, such as contact details provided by the user during the ordering process, will be stored and used in accordance with our Privacy Policy. Online Dispute Resolution If the user has a problem regarding a product purchased on barriqule.com, they can resolve the dispute amicably by sending a communication to the email address provided in our Legal Notices. For questions, clarifications, and any complaints through the ODR Platform, the user is invited to contact us. Jurisdiction and Applicable Law This contract is governed by and interpreted in accordance with Italian law, without prejudice to rights that cannot be otherwise excluded. In particular, the user's rights to take legal action in the courts of their country or to use a mediator to reach an amicable settlement of any dispute, in accordance with applicable laws and consumer protection regulations in their country, are not excluded.
  • In the Shipping Confirmation, we will confirm the courier details and the tracking number as soon as the order is shipped. For any delivery inquiries, please contact us at the address info@barriqule.com​ Once the goods have been delivered to the user and the user has taken physical possession of them, the user becomes the owner of such goods, and from that moment on, any risk of loss, theft, or damage will be borne by the user, in accordance with any applicable laws and regulations. Upon delivery, the user must verify the condition of the order and whether they have received the exact number of items. Missing items will be reordered, and damaged/incorrect items will be returned and, in accordance with these Terms of Sale, replaced and delivered free of charge. The user must inform us of any damaged, missing, and/or incorrect products in accordance with the Warranty under Part D of these Terms of Sale.

Part C - Order Cancellation and Return of Goods

  • We grant a right of withdrawal from the contract for any reason within a reasonable period of 14 days from the date on which the goods were received, allowing the user to cancel their contract within 14 days of receiving the merchandise. Barriqule is not responsible for non-delivery due to the recipient's absence; therefore, after 14 days from the date of receipt of the order, the customer will not be able to enjoy this right. The right of withdrawal can be exercised in relation to one or more purchased items.
  • In the event of withdrawal and return of items, the user is required to take reasonable care of the items and return all unwanted products to us. This 14-day return period allows the user to have an evaluation period for the purchase as normally guaranteed by Italian Law L. D. 206/2005, the European Directive on consumer protection (Directive 2011/83/EU), and all applicable consumer protection laws in their country. For specific terms and conditions applicable to their rights of withdrawal and refund, please send an email to info@barriqule.com.
  • All items must be returned within 14 days of receiving the package. If the return request is made on the 14th day after delivery, the return must be completed by the same day. If the 14th day falls on a holiday, the return may be made by the next business day.

Cancellations

Cancellation is free if it is due to our service disruption.

In all other cases, you can cancel the order only if it has not yet been shipped, and a fee of €10 will be charged to you.

The conversion to other currencies will be made at the exchange rate in effect at the time of the cancellation request according to the Banca Centrale Europea​

Defective goods

  • If the user believes that the delivered goods are not materially in accordance with their description previously provided in the Order Confirmations, are incomplete or damaged, or are defective, and we cannot remedy the issue or defect to their reasonable satisfaction, then such goods may be returned without prejudice to any other rights granted to them by applicable law.

Part D - general conditions of our relationship with the user

Final use only

  • The goods sold on this website are intended exclusively for the private end use of consumers and are not intended for resale or commercial distribution. The user declares that they are purchasing the products as a consumer.

Force majeure events

  • We shall not be liable for any delay or failure to comply with these Terms of Sale or the supplementary Policies if such delay or failure arises from any unforeseeable, unavoidable event beyond our reasonable control, such as accidents, national legislation, court orders, official sanctions or embargoes, industrial action, fire, flood, adverse weather conditions, natural disasters, or any other natural calamity.

Waiver

  • The delay in exercising or the failure to exercise any right or remedy by us under these Terms of Sale shall not constitute a waiver of our rights and remedies under these Terms of Sale.

Nullity

  • If one or more provisions established in these Terms of Sale or in the supplementary Policies are deemed null by a competent authority, to the extent possible, the remaining provisions of the Terms of Sale and the supplementary Policies will remain in effect, and the user will always be bound by them.

Privacy

  • Personal information, such as the contact details provided by the user during the ordering process, will be stored and used in accordance with our Privacy Policy.

Jurisdiction and applicable law

  • This contract is governed by and interpreted in accordance with Italian law, without prejudice to rights that cannot be otherwise excluded. In particular, the user's rights to seek legal recourse in the courts of their country or to use a mediator to reach an amicable settlement of any dispute, in accordance with applicable laws and consumer protection regulations of their country, are not excluded.
